1. Acceptance of Terms
By accessing or using the Eternity platform ("Service") operated by Lights Out Solutions LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
2. The Living Presence Feature
The Living Presence feature allows users to create an AI-generated representation of a deceased individual using uploaded memories, recordings, photographs, and other content. By creating a Living Presence, you represent and warrant that:
You are an authorized family member or legal representative of the deceased individual.
You have the right to upload and use all content submitted to create the Living Presence.
You understand the Living Presence is an AI simulation and not a real communication with the deceased.
You consent to Eternity processing the submitted content to generate the Living Presence.
3. Heaven Cents Recognition System
Heaven Cents are a platform recognition system awarded by community nomination and verification. Heaven Cents have no monetary value, are non-transferable, and cannot be purchased. Eternity reserves the right to grant or revoke Heaven Cents status at its sole discretion.
4. User Content
You retain ownership of all content you upload. By uploading content, you grant Eternity a non-exclusive, worldwide license to use, process, and display that content solely for the purpose of providing and improving the Service. We will never sell your loved one's raw memories, recordings, or photographs to third parties. Aggregated, anonymized data may be used to improve our platform and, with your explicit opt-in consent, to connect you with relevant faith-based partners.
5. Acceptable Use
You agree not to use the Service to create Living Presences of individuals without proper authorization, to upload content you do not have the right to use, to harass, defame, or harm others, or to violate any applicable law or regulation.
6. Subscription and Payments
Paid subscription tiers are billed monthly or annually. You may cancel at any time. Refunds are provided at our discretion. Free waitlist membership carries no payment obligation.
7. Disclaimer of Warranties
The Service is provided "as is." We make no warranties that the Living Presence accurately represents the deceased individual or that the Service will be uninterrupted or error-free. The Living Presence is an AI tool for healing and memory — not a supernatural communication.
8. Limitation of Liability
To the fullest extent permitted by law, Lights Out Solutions LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

These Terms are governed by the laws of the State of Washington, United States.

We will never sell your loved one's raw memories, recordings, photographs, or personal content to third parties. Aggregated, anonymized platform insights may be used to improve our Service and, with your explicit opt-in consent, to connect you with relevant faith-based partners and services.
2. Information We Collect
Account information: Name, email address, and payment information for paid subscribers.
Memorial content: Photos, audio recordings, videos, written letters, and other content you upload to create a Living Presence.
Social media connections: With your explicit permission, memory data synced from platforms such as Facebook.
Usage data: How you interact with the platform, to improve our Service.
3. How We Use Your Information
To create and operate Living Presence profiles as directed by you.
To send you platform updates and your waitlist confirmation.
To process payments for paid subscriptions.
To improve the accuracy and quality of the Living Presence AI.
4. Living Presence Data
Content uploaded to create a Living Presence is stored securely and processed solely to generate that presence. Family stewards retain full control — you may edit, restrict, or permanently delete a Living Presence and all associated data at any time.
5. Data Sharing
We do not sell your data. We may share data with trusted service providers (hosting, payment processing, AI processing) under strict confidentiality agreements. We may disclose data if required by law.
6. Data Security
We use industry-standard encryption and security practices to protect your data. However, no system is 100% secure. We encourage you to use a strong, unique password for your account.
7. Your Rights
You have the right to access, correct, export, or delete your personal data at any time. Contact us at privacy@your-eternity.com to exercise these rights.
8. Children's Privacy
Eternity is not directed at children under 13. We do not knowingly collect personal information from children under 13.
